OVERVIEW
Welcome to Lunarti. The terms "we", "us" and "our" refer to Lunarti. Lunarti operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the "Services"). Lunarti is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or browsing our online store or purchasing any products, you may be asked to provide certain information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 – OUR PRODUCTS & AUTHENTICITY
Every Lunarti artwork is a singular, one-of-a-kind handcrafted work, produced facet by facet over 60 to 100+ hours.
1. Specificity of Imagery
The photographs displayed on a product page depict the exact, specific physical artwork you will receive for "In Stock" items. We do not use stock images or digital renders for available inventory. While we ensure high-fidelity photography, we cannot guarantee that your monitor's display of any color will be accurate. The color calibration of your specific screen may affect the visual tone of the resin facets. All product photography is captured under controlled studio lighting; the appearance of colors, reflectivity, sparkle, and surface texture will vary depending on the ambient lighting, viewing angle, and distance at which the artwork is displayed. Such variation is inherent to the medium and does not constitute a defect or misrepresentation.
2. The Deliberate Artistic Signature (Intentional Variation)
You acknowledge that each mosaic is handcrafted facet by facet. To express authorship and distinguish each piece from mass-produced goods, the Artist intentionally incorporates a unique "signature" into every piece — typically 15 to 20 facets placed with deliberate variation from the standard pattern. These deviations are a mark of individual authorship, not defects.
3. Inventory & Archives
All "In Stock" artworks have an inventory of one (1). Once sold, the specific physical piece is archived. While the exact piece cannot be repurchased, clients may request a "Bespoke Re-Issue" of an archived design. These are treated strictly as Custom Commissions (see Section 3) and will be handcrafted anew. Due to the manual nature of the process, variations will occur between the Re-Issue and the archived original.
4. Visual Representations, Lifestyle Imagery & AI-Generated Content
In addition to studio product photography, Lunarti's website and marketing materials may include lifestyle images, interior environment visualizations, and AI-assisted or digitally generated imagery depicting our artworks in residential, commercial, or hospitality settings (collectively, "Visual Representations").
(a) Illustrative Purpose Only. All Visual Representations are provided for illustrative and inspirational purposes only. They are not intended to constitute an exact, precise, or to-scale depiction of the physical artwork, its dimensions, its surface texture, or its appearance in any specific environment.
(b) Colour, Texture & Finish Variation. The colors, tones, surface sparkle, reflectivity, and crystal mosaic texture visible in any Visual Representation may differ from the physical artwork as displayed in your specific space. Such differences arise from photographic lighting, digital rendering processes, image compression, screen calibration, and the inherent optical properties of faceted resin crystal. These differences do not constitute a misrepresentation of the artwork.
(c) Dimensional & Scale Representation. Artwork dimensions stated on each product page (in centimetres) are the authoritative reference for the physical size of each piece. Any Visual Representation depicting an artwork within an interior environment is not to scale and must not be used as a dimensional reference.
(d) AI-Generated & Digitally Simulated Imagery. Some Visual Representations on our website and marketing channels are created using artificial intelligence image generation tools, digital compositing, or other computational methods. These images are simulations designed to convey the general aesthetic character and spirit of an artwork displayed within a living environment. They are not photographs of actual installed artworks. Lunarti makes no warranty, express or implied, that the artwork's appearance in your environment will match any AI-generated or digitally produced Visual Representation.
(e) Authoritative Product Reference. The definitive reference for any "In Stock" artwork is the dedicated studio product photography on that artwork's individual product page, together with the written product description and stated dimensions. Dissatisfaction based solely on a comparison to a lifestyle image, interior visualisation, or AI-generated scene does not constitute grounds for a return or refund under our Return & Refund Policy.
SECTION 3 – ORDERS
1. Standard Orders
When you place an order for an in-stock item, you are making an offer to purchase that specific finished piece. Payment is collected in full at checkout to secure the artwork.
2. Cancellation & Returns — What to Expect
We want every purchase to feel right. Here is exactly what applies, at each stage:
Within 24 hours of placing your order (before a shipping label is generated) — Full Refund.
You may cancel for a 100% full refund, no questions asked. Email hello@lunarti.com as soon as possible. Once a shipping label is generated your order enters the dispatch process and this window closes.
After 24 hours or once a shipping label is generated — Order in Progress.
At this point the artwork is being prepared for dispatch. We are unable to cancel the order. If you change your mind after receiving the artwork, you may request a return within 14 days of delivery under our Return & Refund Policy.
Returning an artwork after delivery — Important: Not a full refund.
We cover all outbound costs upfront, so you pay nothing extra at checkout. These costs are real and non-recoverable once incurred. If you choose to return an in-stock artwork within 14 days of delivery, the following will be deducted from your refund:
• Outbound shipping, insurance & import duties (DDP): The actual costs of DHL Express shipping, transit insurance, and all US import duties paid on your behalf at the time of dispatch. These are embedded in your purchase price and cannot be recovered once paid.
• Return shipping: The cost of the DHL Express return label issued by Lunarti.
• Restocking fee (cash refund only): 15% of the purchase price, waived if you choose store credit instead.

3. Bespoke Commissions (Custom & Re-Issues)
We accept a limited number of Custom Commissions (including client-provided images such as portraits) and Archive Re-Issues. These are subject to the following terms:
• Non-Refundable Deposit: Work begins only after a non-refundable 50% deposit is received. This covers materials and initial labor.
• Estimated Timeline: At the time of deposit, we will confirm a working timeline with you. While we endeavor to meet all stated timelines, completion dates are estimates and may be affected by material availability and production complexity. We will notify you promptly of any material delays.
• Client-Provided Imagery (Quality & Rights): If you provide a reference image, you agree to submit high-resolution, clear imagery. Lunarti is not responsible for loss of detail or fidelity resulting from low-quality, blurry, or pixelated source images. You represent that you own the rights to any image you submit.
• Artistic Interpretation: You acknowledge that our mosaic technique is an artistic interpretation, not a photorealistic digital print. Variations in color, shading, and detail are inherent to the medium. Subjective dissatisfaction with the artistic style or likeness is not grounds for a refund.
• Digital Proof Approval: Before physical production begins, we will provide a digital simulation or proof for your approval. Approval of this proof constitutes final acceptance of the design direction. Production does not commence until written approval is received from you.
• Final Sale: Completed custom commissions are final sale. We do not accept returns or refunds on bespoke work.
• Abandonment: If the final balance is not paid within 30 days of completion notification, Lunarti reserves the right to retain the deposit and the artwork.
4. Gift Cards
Gift cards purchased through the Lunarti store are subject to the following: (a) Gift cards are valid for purchases on lunarti.com only. (b) Gift cards have no cash redemption value and cannot be returned for a cash refund. (c) Gift cards are treated as Final Sale after the 24-hour cancellation window. (d) Lunarti is not responsible for lost, stolen, or unauthorized use of gift cards.
SECTION 4 – PRICES AND BILLING
1. Price Changes
Prices, discounts, and promotions are subject to change without notice. However, price changes will not apply to any order for which a Dispatch Confirmation or Invoice has already been issued. The price charged will be the price in effect at the time the order is placed.
2. Import Duties & Taxes (DDP Delivery)
To provide a seamless experience for our US collectors, our prices operate on a "Delivered Duty Paid" (DDP) basis. The final price shown at checkout includes all applicable US import duties and tariffs. You will not be charged additional import fees by the carrier upon delivery.
Applicable sales taxes, where required by law, will be calculated and displayed at checkout based on your delivery address.
3. Promotions
We may offer exclusive promotions, private client offers, or seasonal incentives. These offers are governed by terms and conditions separate from these Terms.
4. Payment Information
You agree to provide current, complete, and accurate purchase and account information. You represent and warrant that charges incurred by you will be honored by your credit card company or payment processor (e.g., PayPal).
5. Order Verification & Security
To protect our customers from fraud, we reserve the right to request additional verification (such as identity confirmation) for high-value orders. We may cancel or refund any order flagged as high-risk by our payment processors or security systems without liability.
SECTION 5 – SHIPPING AND DELIVERY
Ownership & Insurance
For customs and regulatory purposes, legal title (ownership) of the artwork transfers to you immediately upon our handover to the carrier (DHL Express). For clarity: although title transfers at this stage to facilitate customs clearance, Lunarti remains responsible for coordinating insured delivery to your address. We maintain a comprehensive Shipping Insurance Policy that protects your purchase against damage or loss during transit until it is delivered to your address, as outlined in our Refund Policy.
Signature Requirement & Secure Delivery
Due to the value of Lunarti artworks, all shipments require a direct signature upon delivery. You are responsible for ensuring a person is available to receive and sign for the package at the provided shipping address. Lunarti is not responsible for packages that cannot be delivered due to unavailability of the recipient, or for items lost or stolen after a confirmed delivery signature has been obtained.
Transit Damage — 48-Hour Report Window
If your artwork arrives damaged, you must report this to us within 48 hours of confirmed delivery, with supporting photographs. This window is required to initiate an insurance claim on your behalf. Failure to report within this window may affect our ability to file an insurance claim and secure a replacement or refund. Please email hello@lunarti.com immediately upon discovery of any damage.
Liability for Delays
Lunarti is not responsible for delays, inspections, or disruptions caused by customs authorities. See Section 14 (Force Majeure) for circumstances beyond our reasonable control.
SECTION 6 – INTELLECTUAL PROPERTY
1. Lunarti Brand & Visual Assets
The Lunarti website, brand name, logo, and all original presentation content — including our product photography, video, text, and curation — are the property of Lunarti and are protected by copyright and common-law trademark rights.
• Photography Rights: The high-resolution photographs of our finished artworks are the exclusive intellectual property of Lunarti. You may not use our images for commercial purposes, third-party sales listings, or digital reproduction without written permission.
2. Nature of the Artwork (Physical vs. Digital)
Our designs are derived from a variety of sources, including licensed patterns, generative digital concepts, and collaborative artistic commissions. Lunarti's intellectual property resides in the physical execution, curation, material composition, finishing, quality control, and the unique hand-placed interpretation of each artwork, as well as all original photography, product narratives, and brand presentation.
3. Display & Usage License
By purchasing a Lunarti artwork, you acquire the physical object together with a licence for display in private, professional, or hospitality environments.
• Permitted Environments: You may display the artwork in private homes, corporate offices, hotels, restaurants, lobbies, and similar venues for decorative purposes.
• No Commercial Exploitation: You may not use the artwork as the primary subject of commercial exploitation without a separate written agreement.
• No Reproduction: Purchase of the artwork does not transfer any reproduction rights. You may not create prints, copies, merchandise, or digital derivatives of the artwork.
Resale: Nothing in these Terms restricts your right to resell the physical artwork you have purchased. However, any resale must not misrepresent the artwork's origin, authorship, or authenticity, and the reproduction restrictions above continue to apply to any subsequent owner.
SECTION 7 – ADDITIONAL DIGITAL SERVICES & SITE ENHANCEMENTS
1. Enhanced User Experience
To provide additional value, we may provide access to integrated third-party digital services, plug-ins, or website features (such as currency converters, order tracking, or customer review interfaces).
2. Service Disclaimer
These additional services are provided by external partners. We provide access to them "as is" and "as available" without warranties of any kind. Lunarti shall have no liability arising from the technical performance of these optional third-party services.
3. Voluntary Use
These features are provided for your convenience. Their functionality is subject to the technical constraints of their respective third-party providers.
SECTION 8 – EXTERNAL RESOURCES & SOCIAL MEDIA
1. External Links
Our Services may contain links to outside websites, social media platforms, or third-party resources not affiliated with or controlled by Lunarti. These links are provided for convenience, inspiration, or information.
2. Independence
We are not responsible for examining or evaluating the content or accuracy of third-party materials. Lunarti does not warrant or endorse any third-party website and assumes no liability for any materials, products, or services of third parties.
3. User Caution
If you access any third-party website linked from our Services, you do so entirely at your own risk and subject to the terms and conditions of that website. Complaints or claims regarding third-party products should be directed to the third party.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Lunarti is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Lunarti. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Lunarti, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Lunarti.
SECTION 10 – PRIVACY POLICY
Your submission of personal information through the store is governed by our Privacy Policy. By using our Services, you acknowledge that you have reviewed and consented to the terms of our data handling practices as outlined in that document.
Lunarti is headquartered in Bulgaria, an EU member state, and processes personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR). Where you are a resident of a jurisdiction with additional data protection rights (including, for example, California residents under the CCPA), those rights are addressed in our Privacy Policy.
SECTION 11 – FEEDBACK
If you submit any ideas, suggestions, feedback, reviews, or proposals (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for the purpose of operating, improving, and promoting the Services.
You represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with its submission; and (iii) your Feedback complies with these Terms. We are under no obligation to maintain your Feedback in confidence, pay compensation for it, or respond to it.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information at any time without prior notice.
Where an error affects a placed order, we will notify you before making any change. If you have already been charged for an order that we subsequently cancel due to a pricing error, we will issue a full refund promptly.
SECTION 13 – PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, state, or local regulations, rules, or laws; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any person; (e) to transmit false or misleading information; (f) to send any unsolicited advertising or promotional material; (g) to impersonate or attempt to impersonate any person or entity; or (h) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm Lunarti, Shopify, or users of the Services.
SECTION 14 – FORCE MAJEURE
Neither Lunarti nor you shall be liable for any failure or delay in performance under these Terms arising from causes beyond that party's reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, epidemic or pandemic, war, terrorism, civil unrest, government actions, strikes or labor disputes, failure of telecommunications infrastructure, or disruptions to global supply chains or logistics networks (each, a "Force Majeure Event").
In the event of a Force Majeure Event affecting our ability to fulfil an order, we will notify you as soon as reasonably practicable and work with you to agree on a revised timeline or, where fulfilment is no longer possible, provide a full refund for the undelivered portion of your order.
SECTION 15 – TERMINATION
1. Voluntary Termination
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
2. Termination by Lunarti
We reserve the right to terminate this agreement or suspend your access to our Services if, in our reasonable judgment, you fail to comply with any term or provision of these Terms. Lunarti reserves the right to refuse service for any lawful reason, including to protect the integrity of our community and brand. We will not refuse service on any basis prohibited by applicable law.
3. Liability on Termination
If we terminate services due to a violation of these Terms, you will remain liable for all amounts due up to and including the date of termination.
SECTION 16 – DISCLAIMER OF WARRANTIES & NO PROFESSIONAL ADVICE
1. General Information
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.
2. Content Disclaimer
Content published by Lunarti, including product stories or artistic commentary, is provided for general informational and inspirational purposes only and does not constitute legal, financial, medical, or professional advice.
3. Express Commitments
This disclaimer does not limit any express commitments we make in writing within these Terms regarding order fulfilment, shipping insurance, or the specific authenticity of our artworks.
4. General Disclaimer
EXCEPT AS EXPRESSLY STATED BY LUNARTI, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.
SECTION 17 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL LUNARTI, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.
Liability Cap: To the maximum extent permitted by applicable law, Lunarti's total aggregate liability to you for any claim arising out of or relating to a specific product purchase shall not exceed the amount actually paid by you for that specific product.
Nothing in this Section shall limit Lunarti's liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; or (c) any liability that cannot be excluded or limited by applicable law.
SECTION 18 – INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Lunarti, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of: (1) your breach of these Terms or the documents they incorporate by reference; (2) your violation of any law or the rights of a third party; or (3) any content you submit or transmit through the Services.
SECTION 19 – SEVERABILITY
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 20 – WAIVER; ENTIRE AGREEMENT
1. No Waiver
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
2. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy (as published on the Site), constitute the entire agreement between you and Lunarti.
3. Incorporation by Reference
The policies referenced above are incorporated into these Terms by reference and form an integral part of the agreement between you and Lunarti.
4. Electronic Communications
You consent to receive communications from us electronically (e.g., via email or site notifications) and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
5. Conflict of Terms (Hierarchy)
These Terms of Service shall govern your use of the Services. Where a specific written policy for a particular product, promotion, or transaction provides greater specificity on a matter covered by these Terms, the specific policy shall govern for that matter only.
SECTION 21 – ASSIGNMENT
You may not delegate, transfer, or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void.
We may transfer, assign, or delegate these Terms and our rights and obligations with reasonable prior notice to you, except in the case of a corporate restructuring, merger, or acquisition of all or substantially all of our assets, in which case we will notify you within a reasonable period following such event.
SECTION 22 – GOVERNING LAW & JURISDICTION
1. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions.
2. Mandatory Consumer Protection Rights
Nothing in these Terms limits or waives any rights that you may have under mandatory consumer protection laws applicable in your state or country of residence that cannot be excluded or modified by agreement. In particular, if you are a resident of the United States, certain state consumer protection statutes may provide you with rights and remedies in addition to, or different from, those set out in these Terms. Such rights are not affected by this agreement.
3. Preferred Venue
Subject to Section 22.2 above, the parties agree to submit disputes primarily to the courts located in Sofia, Bulgaria. Nothing in this Section prevents either party from seeking interim injunctive relief in any court of competent jurisdiction.
4. Language of Proceedings
The parties agree that all legal proceedings, dispute resolutions, or arbitrations arising under these Terms shall be conducted in the English language.
5. Service of Process
You consent to accept service of process via the email address associated with your order or account. You agree that such email service shall be deemed effective, valid, and sufficient for all legal purposes.
SECTION 23 – DISPUTE RESOLUTION
We value every client relationship and prefer to resolve any dispute informally. Before initiating any formal legal proceedings, both parties agree to make a genuine effort to resolve any dispute by direct communication. Please contact us at hello@lunarti.com describing the nature of your concern, and we will endeavor to respond substantively within 10 business days.
Where informal resolution is not achieved, disputes shall be referred to the courts as set out in Section 22, unless the parties mutually agree to an alternative dispute resolution mechanism such as mediation.
SECTION 24 – CHANGES TO TERMS OF SERVICE
You can review the most current version of the Terms of Service at any time on this page.
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. For material changes that affect your rights, we will provide at least 14 days' advance notice by email to the address associated with your account, or by a prominent notice on our website. Your continued use of the Services after the effective date of any change constitutes your acceptance of the new Terms.
